What does it cost to file for bankruptcy?

The total cost of a bankruptcy depends on several factors including the Chapter of Bankruptcy that you file and the complexity of your particular case. You generally need to pay attorney fees, filing fees, and credit counseling fees.

Filing Fees

The Bankruptcy Court charges a filing fee for every bankruptcy petition filed with the Court. Currently, the filing fee for a Chapter 7 “liquidation” Bankruptcy is $335. The filing fee for a Chapter 13 “repayment” Bankruptcy is $310. Attorney fees are not included in these amounts. Depending on your household income, it may be possible to have the Chapter 7 filing fee of $335 waived by the Court and then you would only pay some attorney fees for your bankruptcy case. You must first meet certain criteria in order to qualify for this waiver.

Choosing A Bankruptcy Attorney in Sandusky Ohio

The choice to file a bankruptcy is often a difficult one but in today’s economy it has become inevitable in many circumstances, but it can also help you get your life back on track. If you are in need of a Bankruptcy Attorney in Sandusky Ohio, call today. Don’t get overwhelmed and stressed out about your situation, give a qualified bankruptcy attorney in Sandusky or Toledo Ohio a call and we will help determine which Chapter of Bankruptcy, if any, is best for you and your situation.
There are generally two chapters of bankruptcy that apply to individuals, Chapter 7 and Chapter 13.
A Chapter 7 bankruptcy provides a fresh start and eliminates debt such as credit cards, medical bills, utility bills to name a few. We will need to look at your household size versus your income in determining whether you qualify for this chapter of bankruptcy. Certain debts are not dischargeable in a Chapter 7, for example; child support, spousal support, and student loans. Some assets you own may be at risk if they have excess equity in them. A Chapter 13 bankruptcy is a repayment bankruptcy generally over a period of 5 years and allows you to keep your assets (home, vehicles, etc.) that have excess equity.
Make sure to ask about fees. A lot of clients don’t realize that there are fees associated with filing bankruptcy. While these fees vary from attorney to attorney, we do require a down payment to go to work for you.
